Seattle Immigration Service and Employment-based Visas

At minimum, there are 140,000 employment-based visas issued each year according to the Immigration and Nationality Act.  These visas are divided into five categories, each with its own requirements.  If you do not comply with the appropriate law and regulations while pursuing your Seattle immigration, it can result in delays, application rejections, and appeals, all of which cost time and money.  A Seattle immigration attorney can help prepare and file your application, preventing unnecessary delays and ensuring timely receipt of your employment-based visa.

The visa categories

Visas fall into the following categories:

  • First preference: Priority workers.  This category is for those with extraordinary abilities in art, science, business, athletics, education, and research.
  • Second preference: Professionals with advanced degrees or exceptional ability.  Included here are professionals such as lawyers, physicians, engineers, architects, and educators with advanced degrees.
  • Third preference: Skilled workers in short supply, professionals with baccalaureate degrees, and other workers in short supply.  This preference is for those whose employment requires at least a baccalaureate degree and least two years of specialized experience or training.
  • Fourth preference: Special immigrants Under this category, those with special circumstances may apply.  Those individuals can include religious officials, former United States government employees, and current citizens who wish to sponsor their immigrant siblings in their petition for a visa.
  • Fifth preference: Investor in a new commercial enterprise.  Here, the type of worker desired is one who plans to invest in a business that will benefit the United States economy, including the creation of at least ten new jobs.
