Recoverable Damages
In Washington State, you can recover several types of damages in a personal injury lawsuit. These include property damage (such as damage to your car), past and future medical expenses, lost wages, and lost future earning capacity. In addition, you can recover "general damages," which include the pain and suffering, disability, disfigurement, and emotional distress you suffered due to the accident.
Statute of Limitations
In Washington State, you must file your personal injury lawsuit within three years of the injury. In medical and nursing home malpractice cases, you have three years from the malpractice or one year from discovering (or when you should have discovered) the malpractice to file a lawsuit, whichever is later.
Wrongful Death
A wrongful death case arises when a person dies because of another party's negligent or intentional act. In Washington, the damages that are recoverable in wrongful death cases are different from those in other personal injury cases. In addition to medical and funeral expenses, these can include a number of additional damages depending on whether the deceased is a minor child or adult, or had a spouse or children.
- Minor child: parents can recover for grief, anguish, and emotional distress.
- Adult with spouse or children: the surviving spouse and children may recover for a wide variety of damages, including the pain and suffering that occurred in anticipation of death.
- The decedent's estate can recover for the lost future earning capacity, even if he or she had no surviving dependents.
